Bail refused after alleged threats and protection order breach
A 40-year-old panel beater from Żejtun was remanded in custody on Thursday after pleading not guilty to threatening his former partner, breaching a protection order, and violating previously imposed bail conditions, maltatoday.com.mt reports.
Carlos Falzon was arraigned in connection with an incident allegedly occurring on 8 October at around 3pm. A protection order had already been in place prohibiting him from approaching the woman.
According to evidence presented before the court, a disagreement broke out between the two parties during which Falzon allegedly raised his hand against the woman and made threats towards her. He was subsequently arrested by police.
The prosecuting inspector, Christian Cauchi, told the court that the alleged victim had herself confirmed to police that she had voluntarily spent time with Falzon at the time of the incident, despite the protection order being in force.
In addition to the charges relating to threats and the breaching of the protection order, Falzon was also accused of causing his former partner to fear that violence would be used against her, as well as of breaching bail conditions set in earlier proceedings.
Defence lawyers Matthew Xuereb and Jose Herrera applied for bail, but the court rejected the request, ruling it premature on the grounds that the alleged victim had yet to give her full account of events. Falzon was ordered to remain in custody.
