According to portaltela.pt, a man detained by the GNR in Costa da Caparica, in Almada, on 3 June, on suspicion of domestic violence was released without being interrogated or subjected to any restrictive measures, following a series of procedural failures in Almada Court.
The detention took place at 14:10. The defendant was presented to the criminal investigation judge on 5 June, more than 48 hours later, without the legal deadline for the proceeding having been initiated. The presentation took place at 10:00, with the proceeding scheduled for 13:30 — but the prosecutor and the physical case file were absent at that time.
The defendant's lawyer did not appear at the scheduled time for the afternoon proceeding. Without sufficient time to appoint a court-appointed defence counsel, the interrogation did not take place and the defendant was released.
The case was rescheduled for 12 June, a date on which the judge applied restrictive measures: prohibition of contact with the victim by any means, prohibition of remaining in the shared residence and of approaching within 500 metres of the victim's workplace, with remote technical monitoring.
