Requests for replacement of preventive detention filed at court

Călin Georgescu and Ionel Rusen have submitted requests seeking replacement of their preventive detention, according to Gândul. The request of the former presidential election candidate will be analysed on 5 November, and that of Ionel Rusen on 10 November.

In both cases, the decision of the judge of rights and freedoms at the court will be neither final nor enforceable.

Bucharest Court of Appeal had already recently rejected a previous request from Georgescu and maintained him in preventive detention, in light of the accusations brought by DIICOT. On 28 October, the same court admitted DIICOT's contestation and extended preventive detention for a further 30 days — until no later than 28 November 2026.

"The Bucharest Court of Appeal in case no. 44381/3/2026 admits the contestation of DIICOT-Central, annuls entirely the decision of the judge of rights and freedoms at TMB and upon retrial admits DIICOT's request to extend the preventive detention measure for the accused Georgescu S. Călin and Rusen Ionel, until a new examination, but no later than 30 days, 28.11.2026 inclusive. Rejects the contestation of the accused Rusen Ionel for revocation of the measure. The decision is final", the Bucharest Court of Appeal decision states.

On Tuesday, 3 November, Georgescu was present at the District 1 Court of First Instance, where he was applauded by supporters. The former candidate remained in the courtroom for approximately one hour, after which he was put into a police van and returned to detention. According to Gândul sources, the next hearing in this case is scheduled for 15 December.

The case being tried at the District 1 Court of First Instance concerns alleged acts of Legionary propaganda and promotion of the cult of persons condemned for genocide and war crimes. The case was sent to court in July 2025, and in February 2026 Bucharest Court decided definitively that the trial could commence at the court of first instance.

Separately, in the case handled by DIICOT, Georgescu is accused of forming an organised criminal group and fraud with particularly serious consequences.
