Tuk-tuk confiscated after driving with 2.45 blood alcohol level

A 64-year-old man from the Kalundborg area has been sentenced by the court in Holbæk to 50 days' imprisonment and a fine of 2,000 kroner for reckless driving in a tuk-tuk. This emerges from B.T.'s coverage of a statement from Prosecutor Update.

The man drove around Jyderup in June last year in the three-wheeled motorised cabin with a blood alcohol level of 2.45 and overturned the vehicle in the process. The high alcohol level means that the driving falls under the penal code's provisions on reckless driving.

In addition to the prison sentence and fine, the man was disqualified from driving for a further ten years, and the tuk-tuk was confiscated. The man has previously been charged by police for driving whilst under the influence and for driving without a licence.

During the case, the 64-year-old attempted to have the tuk-tuk classified as a small moped, which would have had implications for sentencing. However, the police obtained information directly from the Italian manufacturer, and the court found on that basis that it was a large moped.

The man is considering appealing the sentence.
