A Málaga court has ordered provisional imprisonment, with communication restrictions and without bail, for the man arrested last Tuesday as the alleged perpetrator of the death of Francisco José Agüera, a 59-year-old resident of Coín whose disappearance has been investigated by the Guardia Civil since April 2020. According to elperiodico.com, the arrested man exercised his right not to testify before the judge heading the number 8 courtroom for preliminary investigations, although the case will be handled by courtroom 14. Sources from the Andalucía High Court of Justice confirmed that he is being investigated for an alleged homicide offence.
The case began in the middle of the pandemic following Agüera's mysterious disappearance, with no further contact from those around him. The discovery that reactivated the investigation occurred in June last year, when two municipal workers found a skull inside a plastic bag in a junction box on a municipal plot of land located in the vicinity of Antequera Street, in a housing estate in the municipality. The remains still retained a lock of hair and showed the absence of one tooth.
Investigators cross-checked the remains against active missing persons reports, and DNA analysis confirmed in February of this year that the skull belonged to Agüera. From that point on, the Guardia Civil focused its inquiries on the now-detained man. During interrogations, the suspect confessed to officers the location of the remains beside one of the access paths to the quarries of Alhaurín de la Torre.
The case adds to a series of violent deaths recorded in Málaga province during the month of July. It is the sixth to come to light this month: the five previous cases involved women, four of them victims of gender-based murders in Antequera, Rincón de la Victoria and Mijas, where a mother and daughter died. The fifth case occurred last week in Benahavís and is attributed to an acquaintance of the victim, who was arrested on Thursday by the Guardia Civil after ten days of searching.
