Prosecutor seeks 9 years imprisonment for deliberate hit-and-run in Esquivias, Toledo
A resident of Esquivias was hit twice by the accused F.M.F.T. in January 2025. The Provincial Court of Toledo will try him on 11 June.
Trial for attempted murder in Esquivias: the accused struck his neighbour twice with a car
The Provincial Court of Toledo will try F.M.F.T. on Thursday, 11 June, accused of attempted murder after deliberately running over a neighbour from Esquivias with a vehicle in the early hours of 29 January 2025. According to ABC, the Public Prosecutor's Office is seeking a sentence of nine years imprisonment.
According to the indictment, F.M.F.T. appeared at the victim's home during the night of 28–29 January and damaged his vehicle with the intention of taking revenge for alleged previous damage to one of his own cars.
At around 05:00, J.J.T.G. looked out of the window, noticed the damage to his vehicle and went down to the street. At that moment, F.M.F.T. was still at the wheel of a car that was subsequently not located by the authorities. According to the Prosecutor, the accused took advantage of the solitude of the night, the narrow and dark nature of the street, the absence of possible escape routes and the superiority afforded by driving the vehicle to launch it head-on against J.J.T.G. on two occasions.
A third attempt was prevented thanks to the intervention of a neighbour, identified as A.C.D., who came upon hearing calls for help, grabbed J.J.T.G. and pulled him into the building's entrance.
Injuries and material damage
The victim suffered a non-displaced fracture of the seventh left rib, a displaced fracture of the ninth posterior left rib and swelling in the right hand. The recovery process, through respiratory therapy and pain management treatment, lasted forty-five days of moderate harm, without permanent consequences.
Prosecutor's request
The Public Prosecutor's Office classifies the facts as the crime of attempted murder and the crime of criminal damage. It is seeking nine years imprisonment for F.M.F.T., special disqualification from the right of passive suffrage during the sentence and a ten-year restraining order from approaching J.J.T.G., his home, place of work and any other place he frequents, as well as a prohibition on communicating with him by any means.
In respect of civil liability, the Prosecutor's Office is demanding that the accused compensate the victim with €3,375 for the injuries, €659.51 for the repair of the damaged vehicle and €600 for the value of an iPhone telephone, in addition to payment of court costs.
