Suspended Sentence for Rape in Mallorca

A British tourist has avoided prison after admitting to raping an unconscious British woman on two occasions in a Magaluf hotel, according to The Olive Press. Billy John Chard, who was 19 years old at the time of the offence, faced seven years in prison but secured a suspended two-year sentence following an agreement with Mallorca prosecutors.

Chard admitted to the rapes against the victim, who was 22 years old at the time, who was unconscious and incapacitated and unable to consent at the BH Mallorca Resort in July 2022. The Palma de Mallorca court took into account his state of intoxication at the time of the attack and procedural delays.

Events of July 2022

The incident occurred on 15 July 2022. Chard met the woman at a poolside party and invited her to his hotel room. She had consumed large quantities of cocaine and vodka before collapsing and losing consciousness. Taking advantage of her vulnerable state, Chard raped her in the shower and subsequently moved her to the bed where he raped her a second time.

The Guardia Civil arrested him three days later. Chard appeared before the Provincial Court of Palma on Thursday, where he admitted to the offences as part of an agreement with prosecutors and the victim's lawyers.

Terms of the Sentence

Under the agreement, Chard must pay €6,000 in compensation to the victim within six months, in monthly instalments of €1,000. He will avoid prison provided he does not reoffend during the next two years.
