The 22-year-old arrested for his alleged involvement in the death of a 27-year-old man following a fight at the TRAM stop at Campo de Golf, at San Juan Beach in Alicante, has been released on provisional bail, according to informacion.es. The ruling was adopted on Saturday by Court Number 6 of the Investigation Section of the Court of First Instance in Alicante, acting as duty court.

The court ordered his release with confiscation of his passport, a prohibition on leaving the country and the obligation to appear periodically before the court. The young man remains under investigation in a case involving a charge of homicide, according to sources at the Superior Court of Justice. The Public Prosecutor's Office had requested his remand in custody.

During the hearing, the defendant was assisted by lawyer José Manuel Yepes Rodríguez. The young man explained that the confrontation—first verbal and then physical—began after the victim had proposed an encounter that he had rejected.

The preliminary autopsy report concludes that the cause of death was cranioencephalic trauma, but does not establish that the kick delivered by the defendant directly caused that trauma. The duty court found no intent to kill and ordered provisional release, taking into account the young man's ties to the area and the absence of flight risk.

The events occurred at approximately 5:30 on Thursday morning in the vicinity of a leisure area at San Juan Beach. The two individuals involved, both Spanish nationals with no prior acquaintance, engaged in a verbal dispute that escalated to physical violence. According to sources close to the case, the 22-year-old delivered a kick to the head of the 27-year-old man, who fell and struck hard against the tracks.

The Emergency Information and Coordination Centre (CICU) received the alert at 5:37. An ambulance from SAMU and a Basic Life Support unit attended the scene. During treatment, the victim suffered cardiac and respiratory arrest; the medical team performed resuscitation manoeuvres and managed to revive him. He was transported to the Dr Balmis General University Hospital in Alicante, where he was admitted to intensive care in very serious condition. The man died on Thursday afternoon as a result of his injuries.

Specialists from the Violent Crime Group (UDEV) of the Provincial Judicial Police Brigade in Alicante took over the investigation to clarify the circumstances of the fight and gather statements from potential witnesses. The detainee was arrested hours after the incident, initially on a charge of grievous bodily harm; the charge was upgraded to homicide after the victim's death was confirmed.

The assault occurred in the same leisure area at San Juan Beach where in October 2022 another young man died after being punched during a fight.
