The magistrate of the Court of First Instance number 1 in Castellón, acting as duty judge, has ordered on Monday the provisional freedom with precautionary measures for the 19-year-old young man arrested in connection with the traffic accident that occurred in the early hours of Sunday on the N-340, at the height of the Magdalena hermitage. The incident resulted in four deaths and six injuries.
According to elperiodicomediterraneo.com, the decision was adopted in accordance with the Public Prosecutor's criteria. The young man remains under investigation, initially and without prejudice to later classification, for four counts of homicide through gross negligence, five counts of injury through gross negligence and one count of violation of road safety regulations.
The Guardia Civil is also investigating him for four counts of gross negligence resulting in death, five counts of injury, one count of reckless driving and one count of violation of road safety regulations for driving under the influence of alcohol.
Precautionary measures imposed
The magistrate has imposed the following obligations on the investigated party: periodic appearances before the judicial office, prohibition on driving motor vehicles, confiscation of passport and prohibition on leaving the national territory.
In support of her decision, the judge assessed the personal circumstances of the detained person—his age, the absence of criminal record and his family and social roots—and concluded that the requirements of article 503 of the Criminal Procedure Act for ordering preventive detention are not met, as she found no risk of flight, destruction of evidence or commission of further offences.
Details of the accident
The young man had been detained on Sunday afternoon by Guardia Civil officers following his hospital discharge. According to the available information to date, he was the driver of the black BMW involved in the incident. The vehicle was carrying several young people; two of its occupants, both 18 years old and from Burriana, lost their lives: one was travelling as co-driver and the other in the rear seats. A third passenger was seriously injured, whilst the driver sustained minor injuries.
In addition to the two young people who died in the BMW, the driver of a taxi—a 40-year-old man from Castellón—and a French woman who was travelling as co-driver in another of the vehicles involved also died. The taxi was carrying three passengers, all male, who were injured. In the third car, apart from the woman who died, was the driver, who also suffered significant injuries.
