Justice Minister Gérald Darmanin has ordered an administrative inquiry into the drafting of a judgment delivered by Bobigny tribunal, in which a mother who filed a complaint for sexual assault on her son is described as a "trendy psychologist".
The case stems from a complaint filed by the woman against the babysitter of her seven-year-old child. The magistrates had ruled for the acquittal of the accused, while indicating at the hearing that they "believed" the child's testimony. Eight months later, the written judgment revealed very different reasoning.
The document states that the mother, "a psychologist and trendy, moreover more bohemian than bourgeois", would have "overreacted" and "led her son into a delusion of victimisation by sexual violence". The text adds a remark in brackets: "Nah, I'm joking even if it's partly true". This sentence, probably an internal note intended for a colleague, was not removed from the final judgment.
The plaintiff's lawyer described this reasoning as "absurd and almost insulting". The mother filed a complaint with the Superior Council of the Judiciary (CSM), denouncing "a judgement of value tainted by malice and bias".
Anne Auclair-Rabinovitch, president of the Bobigny judicial tribunal, described the matter as "intolerable" and assured that "internal measures are in place". The Keeper of the Seals stated that these were facts "of extreme gravity and wholly contrary to judicial ethics".
