A 30-year-old man has been sentenced to one year in prison with immediate custody by Perpignan tribunal for receiving a stolen cross motorbike.

In the early hours of 30 March, municipal CCTV operators spotted an individual pushing a cross motorbike through the streets of Perpignan. The man was attempting unsuccessfully to start the vehicle, without wearing a helmet or gloves. A patrol was dispatched to check on this suspicious behaviour.
When questioned on the spot, the suspect was unable to produce the documents for the two-wheeled vehicle. He claimed to have acquired the motorbike a few hours earlier from a stranger he had met in the street, for the sum of 150 euros. A few hours after his arrest, the vehicle was reported stolen by its legitimate owner, who had only just noticed it was missing when he was about to leave for work.
During his trial, the defendant maintained his account before the tribunal. The presiding judge pointed out the late hour of the purchase — 5:30 in the morning — as well as the 30-kilometre distance between his home and the location where he was intercepted. The prosecutor highlighted the ten previous convictions already on the defendant's record, essentially for theft, and requested a sentence of one year of which four months with probation.
The tribunal ultimately handed down a sentence greater than the prosecution's request: one year's imprisonment accompanied by immediate custody. The man, who was appearing at liberty, left the courtroom escorted by three police officers.
