A 30-year-old man in Malmö has had his prison sentence upheld by the Court of Appeal following a violent attack at a nightclub in March last year. The man attacked a 40-year-old on a toilet after discovering him together with his girlfriend.
The altercation began at O'Learys on Entré, where two groups decided to continue the evening together at Ginbaren on Kalendegatan. During the evening, the 22-year-old girlfriend and the 40-year-old went into a toilet. The 30-year-old boyfriend followed, opened the door and saw the pair. He then struck several punches to the 40-year-old's face.
Three days later, the girlfriend reported the 40-year-old for rape, which led to his arrest. Police examination of the woman's mobile telephone revealed that she and her boyfriend had planned the report to protect him from the assault investigation. The rape suspicions were dropped and the 40-year-old was released.
The woman was convicted of gross false accusation and sentenced to one year's imprisonment and damages of 60,000 kronor. She chose not to appeal.
The boyfriend was acquitted of complicity in gross false accusation but was convicted of assault and sentenced to six months' imprisonment and 16,400 kronor in damages to the assaulted man. The Court of Appeal has now upheld the sentence.
