The Court of Appeal had previously acquitted the man, but the prosecution appealed to the Supreme Court. The ruling has now been delivered with unanimous agreement.
The judges placed particular emphasis on the marked age difference of two decades, the man's senior military position, and the woman's status as a newly employed conscript. According to the court, these circumstances meant that it was insurmountable for the young woman to resist.
The ruling may come to play a role in forthcoming court cases concerning rape under the consent law, as it clarifies how hierarchical relationships and age gaps can factor into the assessment of whether voluntary consent is present.
