A man has been sentenced to four years' imprisonment and a €4,000 fine after being arrested in Logroño with more than 85 grammes of MDMA that he intended to sell.

The arrest took place on the night of 28 October 2021. Officers from the Local Police observed an individual who, upon noticing their presence, quickly moved away on a scooter. The officers intercepted him and, during a search, found a vacuum-sealed bag containing five lumps of ecstasy. The total weight came to 85.13 grammes, with a concentration of 77.2 per cent, valued at €3,711 on the black market, according to data from the Rioja High Court of Justice.

The court found it proven that the accused intended to hide the substance in a park for subsequent distribution. The conviction is based on the body of evidence examined during the trial: police procedures, the detainee's admission that he was carrying the drug, and an expert report on the composition, potency and market price.

The tribunal gave full credibility to the officers' account for its consistency, impartiality and accuracy, rejecting the defendant's argument that possession was for personal use. The quantity seized far exceeded reasonable limits for personal use. Furthermore, the accused only admitted regular cannabis consumption, not ecstasy. The packaging in a single vacuum-sealed container and his spontaneous statement about the need to hide the package next to a hedge strengthened the trafficking thesis.
