Two years imprisonment for continued sexual assault on minor in Ávila, by plea agreement
The Provincial Court of Ávila sentences a man for three sexual assaults on his first cousin's granddaughter, committed in 2023 when the victim was 15 and 16 years old.
Agreed sentence in Ávila for sexual assaults on minor family member
The Provincial Court of Ávila has imposed a two-year prison sentence on a man found guilty of the continued offence of sexual assault on the granddaughter of his father's cousin, according to ABC. The sentence, handed down by plea agreement, was reached between the defendant, the prosecutor and the private prosecution, avoiding the need for a public trial.
Three episodes of assault are considered proven. The defendant is first cousin to the victim's maternal grandfather and exploited that family relationship to commit the offences. The first two assaults took place during summer and in August 2023 at bullfighting celebrations in different towns in Ávila province, when the minor was 15 years old. The third occurred on 14 November 2023 at a residence, when the victim had already turned 16.
On the first occasion, during a barbecue organised by the bullfighting association to which the defendant belonged, the man approached the minor from behind whilst she was placing napkins on a table, put his hand down the back of her trousers and touched her buttock, according to the Ical news agency. In the second episode, he took advantage of the victim's father being in the bathroom to approach her and repeat the same behaviour; the minor elbowed him and asked him to stop. The third assault occurred at an aunt's house: the defendant hugged her, put his hand down the back of her trousers, touched her intimate parts, kissed her on the mouth and asked her if she wanted to be his girlfriend.
The ruling applies the highly qualified mitigating circumstance of reparation for damage, given that the convicted man had advanced compensation to the victim of €6,000 in civil liability. The minor has suffered psychological harm diagnosed as post-traumatic stress disorder as a consequence of the offences.
Criminal proceedings were initiated following investigations by the Police Station in Medina del Campo, in Valladolid.
In addition to the prison sentence, the court has imposed a supervised release measure for six years, which will be implemented once the sentence is served. The judgment also includes a special disqualification from any profession, occupation or activity involving regular and direct contact with minors for 15 years, as well as disqualification from exercising parental authority, guardianship, curatorship, custody or foster care rights for six years.
The sentence also establishes a prohibition on approaching the victim, her home, workplace, school or any place she frequents within 200 metres, and a prohibition on communicating with her by any means for ten years.
