The Public Prosecutor's Office has substantially modified its position in the trial for the homicide of Yoel Quispe, which occurred in the early hours of Christmas Eve 2023 in the centre of A Coruña. Prosecutor Olga Serrano has increased the sentence request for José Luis F. from 14 to 20 years in prison, on the grounds that the acts should be classified as murder rather than homicide.
The change is based on the conviction that the accused acted with the determination to cause the death of the victim, who had no possibility of defending himself. The weapon, a knife that the defendant admitted to having plunged directly into Quispe's heart, was never located, according to reports from La Voz de Galicia.
Furthermore, the Public Prosecutor's Office has now implicated Yared G., a friend of the perpetrator, as an accomplice. During his statement, the latter changed his version several times regarding the ownership of the blade, ultimately admitting that it was his and that he handed it to José Luis F. "out of fear", after his previous statement from the preliminary investigation was recalled. The prosecutor contends that "without his knife there would have been no death" and that he was aware of the high probability that the handing over of the knife would result in Quispe's death. For both she seeks an identical sentence of two decades.
Regarding the third defendant, Aaron L., the Public Prosecutor's Office maintains that there is no criminal responsibility. The private prosecutions have raised their request to 25 years for the first two defendants. The trial will conclude this Friday, at which point the jury panel will retire to deliberate its verdict.
