A preliminary investigation procedure has been launched by the public prosecutor's office of the Grand Duchy against a practitioner specialising in bone and joint surgery. The announcement was made on 28 May by the judicial authorities, which did not directly name the person in question in their statement, in accordance with current practice.
The alleged facts could constitute several criminal offences: wilful violence causing bodily injury, manufacture and use of forged documents, and two types of fraud, including one involving public assistance. The information was revealed by the media outlet Le Quotidien.
It was the Ministry of Health that raised the alarm, informing the prosecutor's office on 21 and 22 April. Health officials suspected the healthcare professional of having performed surgical procedures without any therapeutic necessity. Two independent medical evaluations were carried out. Their conclusions indicate that several interventions may not have complied with recognised medical standards and current scientific knowledge. According to these expert assessments, some people who underwent surgery may have suffered mutilation.
The doctor in question submitted a written response to the magistrates. The prosecutor's office assured that this defence would be examined whilst guaranteeing each party the right to be heard.
The legal counsel of the practitioner made known that he intended to collaborate fully with investigators. The stated objective is to clarify the entirety of this matter and the accusations against him, which he categorically denies.
