Disabled pensioner sentenced to four years for sexual assault on ten-year-old granddaughter
Prague Regional Court on Tuesday sent a sixty-two-year-old disabled pensioner to four years behind bars. According to the non-final ruling, the man sexually assaulted his wife's granddaughter in the Nymburk area in April 2024 when she had not yet reached eleven years of age.
The prosecution alleged that on the day in question the man was looking after two girls. At one point he began to forcefully touch the older of the two. The child resisted by kicking, pushing away and crying for help. Nevertheless the man continued – he reached under her clothes to her intimate parts, kissed her, thrust his tongue into her mouth and placed his head between her thighs. All of this was alleged to have had a sexual nature against her will.
Before the court, the defendant denied all responsibility. He claimed that the girls were playing with a mobile phone while he was cooking in the kitchen. He admitted only that he lifted one of them from the ground because she was rolling around on the floor. He denied any other physical contact and described the entire case as fabricated. He added that he allegedly once caught the girl viewing inappropriate content on her phone.
The mother of the victim presented a completely different account. When the girl's aunt rang to alert her that something was happening, she returned immediately. "I saw my daughter completely devastated, shaking, crying and not understanding how her grandfather could have done this to her," she told the court. She stated that the younger of the sisters threatened the grandfather that she would tell, which allegedly frightened the man.
The victim's sister testified that she heard cries for help. When she entered the room, the man allegedly stopped. "He kept kissing her, touching her all over her body, he left a hickey on her neck. He wanted to sleep with her in the bed," she described. The girl herself told the court that the defendant asked "if he could," she refused, but he continued anyway.
Judge Iva Říhová found both girls credible. "The defendant is entirely reliably convicted by the compelling testimony of the victim and her sister," she stated. She rejected the notion that the child had invented the story for attention or out of revenge. "She gained nothing positive for herself," she noted.
For the crime of sexual assault on a child, imprisonment of up to twelve years was possible. In determining the sentence, the court took into account that the man had not been previously convicted, but also that he does not assess his conduct critically and the victim was developmentally younger than her date of birth would suggest.
The ruling is not final. The man has reserved his right to appeal and continues to deny guilt.
