Georgescu remains in preventive arrest after Court of Appeal rejects request to replace measure

Bucharest Court examines Monday, according to Gândul, the proposal by DIICOT prosecutors to extend by 30 days the preventive arrest of former presidential election candidate Călin Georgescu and businessman Ionel Rusen. The two are being investigated for constituting or initiating an organised criminal group and fraud with exceptionally serious consequences.

At Monday's hearing, both defendants will be brought from arrest to the courtroom. The judge for rights and freedoms will hear the arguments of the defence lawyers, as well as the submissions of the DIICOT prosecutor.

Monday's decision by the court is not final. In the event of appeals, the case will return to the Bucharest Court of Appeal.

Court of Appeal ruled in prosecutors' favour

On Friday, the judges of the Bucharest Court of Appeal completely quashed the decision of Bucharest Court and rejected as unfounded Georgescu's request to replace preventive arrest with house arrest. According to the court minutes, the appeal filed by DIICOT — a structure of the Prosecutor's Office attached to the High Court of Cassation and Justice — was admitted.

The decision was delivered after the two judges in the panel failed to reach a common solution. A panel for resolving divergence was necessary, through the co-opting of a third judge.

On 13 October, Bucharest Court had admitted Georgescu's request to replace preventive arrest with house arrest for 30 days. That decision was not final and was immediately appealed by DIICOT prosecutors. Through the decision delivered Friday, the superior court ruled in prosecutors' favour, so the former candidate remains in preventive arrest.

Fraud case with damage of 1.1 million euros

Călin Georgescu has been in preventive arrest since 29 September 2026, in a case investigated by DIICOT. He is accused of fraud with exceptionally serious consequences and of constituting an organised criminal group.

The investigation concerns an alleged fraud through which a businessman was prejudiced by approximately 1.1 million euros, in the context of a transaction that involved obtaining financing for operations with precious metals.

The Court of Appeal's decision concerns exclusively the preventive measure and does not represent a ruling on the merits of the case. Călin Georgescu benefits from the presumption of innocence.
